Hi
I've heard the news that I can't Mix Plan Business that exceeds 300 is it true or not? Currently, I have a customer who buys a Mix Plan Business that exceeds 300, can I still back it up or not...

Feb 27, 2024Dear ClaudioStallone,
I gave very straight forward question & still seems to be no answer. According to MCA only valid document & rule, which customer is obliged to follow document is Product Terms. Same PT clearly stating that FAQ are not part of those. I have putted snapshot of Product Terms where nowhere You can read that 300 limit is COMBINED limit for all plans. There is stating that there is 300 limit, which can be read as per plan. Sorry to say, but Handbook (however it is rule for partner) for customer is valid same way like obsolete train ticket. So question from customer is strigth forward " Can You clearly indicate statement in Product Terms (as only valid document according to Microsoft Customer Agreement", where 300 seats COMBINED limit for all seats is mentioned?

Hi Deleted
As you can read in the Product Terms here: https://www.microsoft.com/licensing/terms/productoffering/Microsoft365/MCA
Microsoft 365 Business Basic/Standard/Premium Use Rights
Customer may not provision more than 300 user subscription licenses.
It is therefore clearly regulated that you are not allowed to have more than 300 user subscriptions.
During the Microsoft-led migration period, beginning January 11, 2024, subscriptions that exceed the established limits will not be renewed. Customer subscriptions with more than 300 active licenses for a legacy offer on a per-user product that falls under this policy will not be migrated to new commerce at renewal date. These subscriptions will then move to an expired state and cannot be reactivated. Enterprise SKUs are available, and customers who exceed the limit will need to purchase the corresponding products.
- Jo_SoapMar 11, 2024Copper ContributorI've seen a Tenant provision 300 Business Premium + 300 Business Standard + 290 Business Basic all on NCE after that date. What gives?
Also perhaps Microsoft should better clarify, as the term "user subscription" throws us off if not read carefully. In NCE terms a "subscription" is only 1 (i.e. Business Premium NCE COM MTH) in which there are up to 300 licenses. But I gather "user subscription" refers to the "licenses".
One other thing that is unclear, what is Microsoft's official stance on mixing 300 Business Premium Licenses with M365 Enterprise E3 Licenses? Because the former has Defender for Business while the latter has Defender for Endpoint P1. Is this still compliant? I was also told that security algorithms change as one progresses to Enterprise Plan, so should a business go from 300 x Business Premium to 0 x Business Premium + 301 x M365 E3, or should they stick to 300 x Business Premium + 1 x M365 E3? Is it really still compliant to mix that?- LicensingConcierge1Mar 11, 2024

Hi Jo_Soap
I've seen a Tenant provision 300 Business Premium + 300 Business Standard + 290 Business Basic all on NCE after that date. What gives? I am awaiting a response from the Business Planning team to get a unified response, so that everyone has the same compliance requirements and purchasing requirements. Please stand by and thank you for your patience.
I've escalated the context of the NCE Handbook. I'll update everyone on this post asap. Sorry for any inconvenience and/or delays in this understanding. Please stand by and thank you for your patience.
One other thing that is unclear, what is Microsoft's official stance on mixing 300 Business Premium Licenses with M365 Enterprise E3 Licenses? This is a great question, so it would be helpful if you created a new post this these two M365 E3 questions.
In the meantime, M365 Business plans (including Premium) can be combined with other subscriptions:

Because the former has Defender for Business while the latter has Defender for Endpoint P1. Is this still compliant?
M365 Business Premium includes everything in M365 Business Standard, plus Microsoft Defender for Business.
M365 Enterprise is designed for large organizations, but it can also be used for medium-sized and small businesses. Also, you can have Microsoft Defender for Endpoint, Microsoft Defender for Business, or another Microsoft 365 Enterprise subscription to the same account.
I was also told that security algorithms change as one progresses to Enterprise Plan, so should a business go from 300 x Business Premium to 0 x Business Premium + 301 x M365 E3, or should they stick to 300 x Business Premium + 1 x M365 E3? Is it really still compliant to mix that?
The Offer Matrix should be used to determine which offers a particular SKU may be upgraded to:

- DeletedFeb 27, 2024Hi. No it is clearly regulated that for each of metioned plans Basic/Standard/Premium you cannot provision more than 300 units. 🙂 I do believe that Microsoft shall update wording & this will solve customers concern. Same wordin is in Polish version.
